By accessing or using Shoeglazer (the "Service"), you agree to be bound by these Terms and Conditions. Shoeglazer is a product and wholly owned service of Velopose Labs LLC. If you do not agree to all of these terms, do not use the Service. References to "we", "us", "our", or "Shoeglazer" throughout these terms refer directly to Velopose Labs LLC, including its creators, operators, contributors, and affiliates.

1. Assumption of Risk: Hearing Health and Equipment Damage

WARNING: EXTREME AUDIO LEVELS AND FEEDBACK LOOPS. The Service utilizes real-time Digital Signal Processing (DSP), which is capable of generating high-gain distortion, self-oscillating delays, and unpredictable volume spikes. By routing your instrument through a web browser, sudden audio artifacts, system latency, or feedback loops can occur instantly.

Mandatory Volume Protocol: You explicitly agree to always start with your system volume, interface volume, and the application's Master Volume at the lowest possible setting before enabling any digital pedals or beginning play. You agree to increase the volume slowly to a comfortable level only after the signal chain is active and producing sound.

Waiver of Liability: Under no circumstances shall Velopose Labs LLC or its creators be held liable for any physical harm, including but not limited to tinnitus, temporary hearing loss, or permanent hearing damage. Furthermore, Velopose Labs LLC and its creators are not responsible for any damage to physical hardware, including blown studio monitors, headphones, audio interfaces, or connected amplifiers resulting from the use of this Service.

2. Intellectual Property and Hardware Emulation

The DSP algorithms, signal chains, and visual layouts provided by the Service are original mathematical models and code written from the ground up.

Hardware References: Any similarities to physical hardware, analog guitar pedals, brand names, or specific manufacturers are used strictly for nominative, descriptive, and educational purposes to describe the sonic character or historical inspiration of our digital models.

No Affiliation: Shoeglazer is entirely independent. We are not affiliated with, endorsed by, or sponsored by any guitar pedal manufacturers, hardware brands, or musicians mentioned within the application or by the AI engine. The Service does not contain cloned, stolen, or decompiled proprietary code from any third-party manufacturer.

3. AI Tone Crafting and Generation Accuracy

The Service utilizes artificial intelligence ("AI Engine") to generate pedal combinations, DSP parameters, and signal routing based on user text prompts.

Subjectivity of Tone: Audio perception is inherently subjective. The AI Engine is an experimental tool designed to assist in tone crafting. We make no warranties, representations, or guarantees that the AI-generated settings will perfectly match the tone of a specific artist, song, era, or user expectation.

System Precision and Hallucinations: AI technologies can occasionally produce unexpected, inaccurate, or non-functional parameter configurations ("hallucinations"). You acknowledge that AI-generated DSP settings may result in silence, extreme volume, or unpleasant audio artifacts. The Service provides these AI generations on an "as-is" basis without any warranty of precision, accuracy, or musicality.

4. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Velopose Labs LLC, its creators, directors, employees, or agents be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of hearing, damaged audio equipment, loss of profits, goodwill, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Service.

5. Acceptance

Continued use of the Service after any modification of these Terms constitutes your acceptance of the revised Terms. If you do not agree, discontinue use of the Service immediately.
